Proposed Legislation Would Grant New York’s Immigrants State “Citizenship”

A group led by New York state Sen. Me Ho Rivero launched Monday a campaign that proposes awarding state “citizenship” to the estimated 2.7 million immigrants who live in the Empire State, regardless of their immigration status.

“We have failed with immigration reform nationally and what we want is to provide an opportunity for the almost 3 million people who live and contribute to the public treasury in our state to take part in its political, civic and economic life,” Rivero told Efe Monday before introducing the bill.   Continue reading

This highlights the two classes of citizenship. State citizenship, which used to be the only citizenship prior to the 14th amendment, and federal citizenship, which is the super-citizenship class that overrides any limitations on State citizens.

This Act should actually be found unconstitutional, since Congress was given the enumerated power to make uniform rules of citizenship, which even applied to the previous State citizenship, so if it does go through, someone should immediately challenge it in federal court.
